News Alert: HUD Releases New Continuum of Care Regulations

This morning, the U.S. Department of Housing and Urban Development (HUD) released interim regulations for the new Continuum of Care (CoC) program under the HEARTH Act and a summary of these regulations.

The regulation primarily address the eligible activities and program requirements of the CoC program. The new program has five eligible components:
  • Permanent housing, which includes permanent supportive housing for people with disabilities and rapid re-housing;
  • Transitional housing;
  • Supportive services only;
  • Homeless Management Information Systems (HMIS); and
  • Prevention, which is available only for CoCs who are designated as High Performing Communities.
All projects that are currently funded through the Supportive Housing Program, Shelter Plus Care, and Moderate Rehabilitation/Single Room Occupancy (SRO) can continue to be funded. However, funding will not be available for new Safe Haven or SRO projects.

In addition to describing the CoC program, the interim regulation address other elements of a Continuum of Care. CoCs will be required to develop a governance structure with a board; operate a centralized or coordinated assessment system; and ensure participation in HMIS.

The interim regulations are expected to be officially published in the Federal Register sometime in the coming week and will go into effect 30 days after that publication date. HUD is encouraging the public to comment on the interim regulations, and comments will be due 60 days after publication in the Federal Register.
